Tequila 512 filed a lawsuit against supermodel Kendall Jenner’s 818 Tequila on 16th February citing trademark infringement, unfair competition and false designation.
512 claims that the two tequilas are extremely similar and has accused 818 of stealing their branding which can confuse consumers. They cited that 818’s black print as well as their color scheme are highly similar to their bottle adding that the three-digit code area are similar to their three-digit code.
“Customers would easily believe, incorrectly, that the products are related,” read the court documents.
Kendall’s sister Kim Kardashian has also been pulled into the court brawl as 512 claims that their bottle design has been used in Kim’s Hollywood game adding that they are not in any form of partnership.
512 revealed that once they discovered that their bottle was in the game they immediately reached out to the game’s representatives and asked them to change the design to which they did change it to green but later on reverted back to yellow.
“The image that Defendant used in the app was of a bottle of Plaintiff’s 512 Tequila, plaintiff did not authorize this use in any way. Either Defendant intentionally used Plaintiff’s bottle, hoping to further blur the lines between the two products, or Defendant was itself confused about the difference between the two brands,” read the court documents.
Kendall is yet to speak on the whole situation but 818’s company representative gave a statement to TMZ saying that they are reviewing the complaint but believe that the allegations are without merit.
